Article 1 - Characteristics of the Goods Offered
The products offered are those listed in the spare parts catalog on our site, under the "Online Store" tab. You will also find technical manuals and installation advice there.
Article 2 - Prices
The prices of our products are indicated in euros, including all taxes (VAT and other applicable taxes on the day of the order), unless otherwise stated and excluding processing and shipping costs.
In the case of an order to a country other than mainland France, you are the importer of the product(s) concerned. Customs duties or other local taxes or import duties or state taxes may be payable. These duties and sums are not the responsibility of AXONE SPADONE. They will be at your expense and are your sole responsibility, both in terms of declarations and payments to the competent authorities and bodies in your country. We advise you to inquire about these aspects with your local authorities.
All orders, regardless of their origin, are payable in euros.
AXONE SPADONE reserves the right to modify its prices at any time, but the product will be billed based on the rate in effect at the time of order validation and subject to availability.
The products remain the property of AXONE SPADONE until full payment of the price.
Note: As soon as you physically take possession of the ordered products, the risk of loss or damage to the products is transferred to you.

The contractual information is presented in French and will be confirmed at the latest when your order is validated.
AXONE SPADONE reserves the right not to record a payment and not to confirm an order for any reason, particularly in the event of supply issues, or in the event of a problem with the received order.
Article 4 - Order Validation
Any order placed on the website https://www.axone-spadone.fr implies acceptance of these General Conditions. Any confirmation of an order entails your full and complete adherence to these general terms of sale, without exception or reservation.
All the data provided and the recorded confirmation will serve as proof of the transaction.
You declare that you are fully aware of this.
The order confirmation will constitute a signature and acceptance of the operations carried out.
A summary of the information of your order and these General Conditions will be provided to you in PDF format via the confirmation email address of your order.
Article 5 - Payment Terms
Validating your order implies an obligation for you to pay the indicated price.
Payments will be made by credit card; they will be processed through the secure system provided on this site, which uses the SSL (Secure Socket Layer) protocol so that the transmitted information is encrypted by software and no third party can access it during transmission over the network.
For payment by check or bank transfer, the shipment of the goods will take place after receipt of the check or transfer.
An invoice showing the VAT can be obtained at any time in the "My Account" area, under the "Order History and Details" section. At the buyer's request, a paper copy will be sent to them.
Article 6 - Deliveries
The products are delivered to the delivery address indicated during the ordering process, within the timeframe specified on the order confirmation page.
In case of a shipping delay, an email will be sent to inform you of any potential impact on the delivery timeline that was provided to you.
In accordance with legal provisions, in case of a delivery delay, you have the option to cancel the order under the conditions and terms defined in Article L 138-2 of the Consumer Code. If in the meantime you receive the product, we will proceed with its refund and the shipping costs under the conditions of Article L 138-3 of the Consumer Code.
In the event of delivery by a carrier, the company AXONE SPADONE cannot be held responsible for delivery delays exclusively due to the unavailability of the customer after several appointment proposals.
Article 7 - Warranty
All our products come with the legal warranty of conformity and the warranty against hidden defects, as provided by articles 1641 and following of the Civil Code. In case of non-conformity of a sold product, it can be returned, exchanged, or refunded.
All claims, exchange or refund requests must be made by email, phone, or postal mail within 30 days after delivery.
The products must be returned to us in the condition you received them with all accompanying items (accessories, packaging, instructions...). Shipping costs will be refunded based on the charged rate and return costs will be refunded upon presentation of proof.
The provisions of this Article do not prevent you from benefiting from the right of withdrawal provided for in the article "Order Cancellation".
Article 8 - Liability
The products offered comply with the current French legislation. The responsibility of AXONE SPADONE cannot be engaged in case of non-compliance with the legislation of the country where the product is delivered. It is your responsibility to check with local authorities the possibilities of importing or using the products or services you plan to order.
Furthermore, AXONE SPADONE cannot be held responsible for damages resulting from improper use of the purchased product.
Finally, the responsibility of AXONE SPADONE cannot be engaged for any inconveniences or damages inherent in the use of the Internet network, including service interruption, external intrusion, or the presence of computer viruses.
Article 9 - Personal Data
AXONE SPADONE reserves the right to collect personal information and data concerning you. They are necessary for the management of your order, as well as for the improvement of the services and information we send you.
They may also be transmitted to companies that contribute to these relationships, such as those responsible for the execution of services and orders for their management, execution, processing, and payment.
These information and data are also retained for security purposes, in order to comply with legal and regulatory obligations.
In accordance with the law of January 6, 1978, you have the right to access, rectify, and oppose personal information and data concerning you, directly on the website.
Article 10 - Dispute Resolution
These online sales terms and conditions are subject to French law.
In the event of a dispute, jurisdiction is assigned to the Commercial Court of Belfort.
Article 11 - Intellectual Property
All the elements of the site https://www.axone-spadone.fr are and remain the intellectual property and exclusive property of the company AXONE SPADONE. No one is authorized to reproduce, exploit, redistribute, or use in any way whatsoever, even partially, elements of the site whether they are software, visual or audio. Any simple or hypertext link is strictly prohibited without the express written consent of the company AXONE SPADONE.
Article 12 - Archiving Proof
The company AXONE SPADONE will archive purchase orders and invoices on a reliable and durable medium constituting a true copy in accordance with the provisions of Article 1348 of the Civil Code.
The computerized records of the company AXONE SPADONE will be considered by all concerned parties as proof of communications, orders, payments, and transactions that occurred between the parties.
Cancellation of an order / Return of merchandise
In accordance with the provisions of Article L.121-21 of the Consumer Code, you have a withdrawal period of 14 days from the day after receiving your products to exercise your right of withdrawal without having to provide reasons or pay penalties. We have relaxed these conditions: for a return received at our premises within 30 days from the date of receipt of your order, you will be fully refunded.
EXCEPTIONS TO THE RIGHT OF WITHDRAWAL
In accordance with the provisions of Article L.121-21-8 of the Consumer Code, the right of withdrawal does not apply to the supply of goods made to the consumer's specifications or clearly personalized. Custom-painted products, garage doors, or custom-made products are therefore excluded from return rights. Returns must be made in their original and complete condition (packaging, accessories, instructions). In this context, you are responsible. Any damage to the product during this time may prevent the right of withdrawal. We cover return costs via Colissimo and only from mainland France. If your order was not delivered by Colissimo or outside mainland France, return costs are your responsibility. If you are eligible for free return, after contacting our "order service", we will send you a Colissimo Return label to affix to your package. You have 30 days to return your package to us; after this period, your return request will be canceled. In the event of exercising the right of withdrawal, AXONE SPADONE will reimburse the amounts paid within 14 days following the receipt of the returned goods. The refund will be made using the same payment method chosen by the customer at the time of the order or by issuing a voucher.

The refund amount will be calculated as follows:
The amount will be equal to the price including VAT (all taxes included) of the product, delivery charges included.
For product returns, the refund is issued within 14 days following the receipt of the returned package.
The method for returning your merchandise:
Your shipment must be made in a way that it can be tracked. Ideally, we recommend La Poste's Colissimo Suivi. You can also provide us with this tracking number so that we can monitor the progress of your case and optimize its processing as well as your refund.
Warning: Proof of return and receipt of the merchandise by us is your responsibility. You are responsible for the returned product. Therefore, no refund or exchange will be processed if all the aforementioned instructions are not followed.
The responsibility for returning the goods remains entirely with you.
